Three hospital employees and seven sheriff’s deputies in Virginia were arrested and charged with second-degree murder in the death of Irvo Otieno, a 28-year-old Black man who died at a state mental health facility last week.

The Dinwiddie County Commonwealth’s Attorney’s Office said in a statement Tuesday that the seven Henrico County deputies were charged with second-degree murder in the March 6 death of Otieno.

At a court hearing Wednesday, Commonwealth’s Attorney Ann Cabell Baskervill said Otieno died of asphyxia due to being smothered to death, thanks to having at least seven people, including the defendant, on top of him and holding him down.

The three hospital employees were arrested Thursday and charged with second-degree murder in the death of Otieno. The Office of the Commonwealth’s Attorney for Dinwiddie County said in a news release obtained by CNN affiliate WTVR that the employees were charged with involuntary manslaughter, obstruction of justice, and failure to provide medical care.

The Dinwiddie County Sheriff’s Office said in a statement that it is continuing to investigate the incident and that it is “committed to providing justice for the victim and his family.”
