Supreme Court Called Upon to Decide Whether Former President Donald Trump is Constitutionally Eligible to Appear on Colorado’s Republican Primary Ballot

A group of Colorado voters have called on the Supreme Court to decide whether former President Donald Trump is constitutionally eligible to appear on the state’s Republican primary ballot. The appeal comes after Maine’s Secretary of State, Shenna Bellows, became the first in history to bar someone from running for the presidency under the rarely used Section 3 of the 14th Amendment.

Trump appealed the Maine decision on Tuesday, and the Colorado voters have now urged the Supreme Court to take up an appeal from the Colorado Republican Party. The filing from the four Republican and two unaffiliated voters stated that the case is of the “utmost importance” and warrants quick action so the question is decided when they cast their primary ballots.

The issue revolves around the Constitution’s so-called insurrection clause, which states that anyone who has “engaged in insurrection or rebellion” against the United States is disqualified from holding office. Trump is accused of inciting the Jan. 6, 2021 attack on the U.S. Capitol, and the Colorado voters believe that the Supreme Court should rule on his eligibility to return to the presidency.

Trump is expected to ask the Supreme Court to rule on his eligibility in the related Colorado case. The outcome of the case could have a major impact on the Republican Party’s future, as it could determine whether Trump is able to run for office again.
