A man who has been the subject of conspiracy theories about the Capitol riot has been charged with disorderly conduct for his actions at the U.S. Capitol on Jan. 6, 2021. Ray Epps, a participant in the Jan. 6 attack, was charged in connection with the incident on Tuesday.

According to a criminal information filed in federal court in Washington, D.C., Epps knowingly engaged in “disorderly and disruptive conduct” on restricted federal grounds. The charge carries a maximum penalty of six months in prison.

Not long after he was charged, a virtual plea agreement hearing was set for Wednesday, Sept. 20 before Chief Judge James Boasberg. He was charged by information, suggesting that he plans to enter a plea deal.

Epps’ removal from the FBI’s Capitol Violence webpage sparked conspiracy theories that he was a federal informant. However, the FBI has not commented on the matter and there is no evidence to suggest that Epps was working with the federal government.

The charge against Epps is the latest in a series of charges brought against participants in the Capitol attack. The FBI has identified more than 400 suspects in connection with the incident and has charged more than 300 people. The investigation is ongoing.
