Panera Bread is facing a lawsuit after its Charged Lemonade was linked to the death of a second person. On Monday, a lawsuit was filed in Superior Court in Delaware on behalf of Dennis Brown’s mother, sister and brother.

Brown, 46, of Fleming Island, Florida, had a chromosomal deficiency disorder, a developmental delay and a mild intellectual disability. He was also diagnosed with high blood pressure and did not consume energy drinks.

On October 9, Brown drank three Charged Lemonades from a local Panera and then suffered a fatal cardiac arrest while walking home. The suit claims that Brown unknowingly consumed high levels of caffeine from the drinks.

This is the second lawsuit against Panera in connection with its Charged Lemonade. In December, the company was hit with a separate lawsuit after a 16-year-old girl died after drinking the beverage.

Panera has yet to comment on the lawsuit. The company has previously stated that its Charged Lemonade contains about the same amount of caffeine as a cup of coffee.
