A 55-year-old Florida man, Herbert Swilley, was taken into custody last Friday in connection to the death of his husband, Timothy Smith, 59. Smith’s body was found earlier this year in an Ocala apartment the couple maintained together.
The Marion County Sheriff’s Office said that an investigation found that Smith had 30 times more than the “normal therapeutic dose” of diphenhydramine, an ingredient found in Benadryl. He also had blunt force trauma to his face and genitalia and a dark ligature mark on his neck.
The sheriff’s office also said that Swilley had raised thousands of dollars on a GoFundMe page following the death of his husband. Swilley was arrested on murder and evidence-tampering charges.
The sheriff’s office shared a video of Swilley being escorted to the jail. Inside, the responding deputies found the 59-year-old already deceased. The investigation is ongoing and further details are expected to be released in the coming days.
