U.S. District Court Judge Tanya Chutkan said in a court filing Wednesday that her comments during sentencing hearings for Jan. 6 rioters, which Trump cited in his attempt to remove her from the case, came from “intrajudicial sources” that were part of the case records and do not warrant recusal.
Judge Chutkan wrote in her opinion that her comments in other Jan. 6 cases, which Trump’s team took issue with, “reflect the information and arguments presented by the defense in each case.” She also noted that she “has never taken the position the defense ascribes to it: that former ‘President Trump should be prosecuted and imprisoned.'”
This case is one of two federal cases being prosecuted by special counsel Jack Smith, who was named in November 2022. Trump’s legal team argued that Judge Chutkan’s comments disqualified her from the case, but she disagreed and denied the request for recusal.
