A Florida state attorney has announced that there is insufficient evidence to pursue murder charges against a white woman accused of fatally shooting her black neighbor through a door.

State Attorney William Gladson said that the burden for a second-degree murder charge requires prosecutors to prove “beyond and to the exclusion of every reasonable doubt, the existence of a depraved mind toward the victim at the time of the killing.” This would require evidence of hatred, spite, ill will or evil intent toward the victim at the time of the killing.

The accused woman, identified as Nancy Lorincz, was arrested in August after police responded to a call of shots fired at her home in Port St. Lucie, Florida. Upon arrival, police found her neighbor, identified as Gregory Frazier, dead from a gunshot wound.

In a statement, Gladson expressed his regret that he could not pursue a murder charge in this case. He said, “As deplorable as the defendant’s actions were in this case, there is insufficient evidence to prove this specific and required element of second-degree murder.”

The case has been referred to the State Attorney’s Office for review and possible prosecution for lesser charges. Lorincz is currently being held in the St. Lucie County Jail without bond.
