The family of an 11-year-old boy in Mississippi has filed a $5 million lawsuit against the city of Indianola and the police officers they allege are responsible for the shooting of the child earlier this month.

According to court documents filed in the U.S. District Court for the Northern District of Mississippi, Aderrien Murry was shot by Greg Capers, one of the responding officers, after police were called to the family home at about 4 a.m. on May 20 to investigate reports of a domestic disturbance.

The lawsuit states that Aderrien’s mother, Nakala Murry, gave her cell phone to her son and asked him to call her mother and the police after her daughter’s father knocked on the door and “stated he was irate.” Nakala Murry told Aderrien to call police because she feared for her and her children’s safety.

When police arrived, Aderrien was turning the corner of his home’s hallway when he was “instantly shot” by Capers, according to the lawsuit.

The lawsuit alleges excessive force and negligence against the police officer who shot the child and is seeking $5 million in damages. The family’s attorney, Carlos Moore, said the lawsuit is meant to send a message to the Indianola Police Department and other police departments across the country that “this type of behavior will not be tolerated.”
