Arizona Court of Appeals Upholds Lower Court Ruling, Denying Kari Lake’s Request to Set Aside 2022 Election Results

The Arizona Court of Appeals has denied Kari Lake’s request to set aside the results of the 2022 election for governor. Lake, a prominent election denier and Trump ally, had filed a 70-page lawsuit in Maricopa County Superior Court in December, alleging that the election results were tainted by illegal votes and misconduct by election officials.

The three-judge panel upheld the lower court ruling that Lake had not provided evidence to support her claims. Chief Judge Kent E. Cattani wrote in the decision that the evidence presented to the Superior Court ultimately supported the court’s conclusion that voters were able to cast their ballots, that votes were counted correctly, and that no other basis justifies setting aside the election results.

The court also noted that Lake’s arguments highlighted election-day difficulties, but that her request for relief failed because the evidence presented to the court did not support her claims. The court said that they could not accept “an untethered assertion of uncertainty” in place of evidence.

The decision of the Arizona Court of Appeals is the latest in a series of court rulings that have rejected attempts to set aside the results of the 2022 election. The court’s decision is final and cannot be appealed.
